I wasn't wearing a helmet. Can I still recover?
Yes. Missouri has limited adult helmet requirements and Illinois has no helmet law for adults. Even where a helmet was required, that issue affects head injury damages specifically, not the whole case.
The driver says he didn't see me. Does that matter?
'I didn't see him' is not a defense. Drivers are required to see what is there to be seen. That statement usually helps us.
What if I was partly at fault?
Missouri uses pure comparative fault, so you can still recover. Illinois bars recovery if you are more than 50% at fault, but less than that still allows a reduced recovery. We analyze the facts carefully.
