Administrative license suspension

A license suspension imposed by the state DMV separate from any criminal court action.

Administrative license suspensions are civil actions taken by the state's licensing authority (Missouri Department of Revenue or Illinois Secretary of State) based on the DUI/DWI arrest and chemical test results, separate from the criminal case.

These suspensions can take effect even if the criminal case is dismissed. The administrative process moves on its own timeline with its own deadlines: 15 days in Missouri to request a hearing, 46 days in Illinois to file a Petition to Rescind the Statutory Summary Suspension.

Missing the administrative deadline waives the right to contest the suspension. Even if the criminal case ends in your favor, the license suspension can stand if the administrative deadline passed.
